The congressional select committee investigating the deadly Jan. 6, 2021 attack on the U.S. Capitol is set to hold a surprise hearing Tuesday, where they will hear testimony from Cassidy Hutchinson, a top aide in Donald Trump’s White House and a critical “eyewitness” in the investigation.

The hearing is a surprise to some as the panel originally announced last week there would be no further meetings until July.

Last Thursday’s hearing included testimony from the three top legal officials who led the department in the final days of the Trump administration, former president Donald Trump’s Acting Attorney General Jeffrey Rosen, Acting Deputy Attorney General Richard Donoghue and the head of the Office of Legal Counsel Steven Engel.

Donoghue testified about a tense meeting with officials in the Oval Office, where he recounted Trump saying “people tell me I should just get rid of both of you. I should just remove you and make a change in the leadership with Jeff Clark and maybe something will get done.”

The former Acting Deputy AG said he replied “Mr. President you should have the leadership you want but understand — the United States Justice Department functions on facts, evidence and law, and those are not going to change.”

After the hearings, the committee said its investigation will continue and panel members will eventually have to decide whether they have found criminal activity and if so, whether they should refer it to the Justice Department. The department, which is conducting its own investigation, could take or leave the recommendation.
