In this Constitutional Law Matters video, Alison Young considers the UNISON case in which the Supreme Court interpreted a broad discretionary power, given to the Lord Chancellor, to set the fees for employment tribunals. The Court concluded that this broad power did not include the ability to set fees at such a level that it made it practically impossible for people on low incomes to go to the tribunal to protect their rights. Professor Young considers why some see this case as constitutionally controversial.
