The U.S. Senate passed bipartisan legislation on Tuesday night that would protect both same-sex and interracial marriage in the country. The landmark legislation is set to head to the House of Representatives, which is expected to pass the bill as early as next week before it heads to President Joe Biden’s desk to be signed.

Twelve Republicans joined Democrats to pass the bill, clearing the filibuster hurdle that can sometimes stall bills from passage. The House will still need to take up the Senate’s version of the bill and pass it for it to go to Biden’s desk. Democrat and Republican senators spoke on Wednesday about the passage, praising the bipartisan work to pass the bill.

The bill would not force any state to allow same-sex couples to marry. However, states would be required to recognize all marriages that were legal when they were performed and protect current unions. The legislation would also protect interracial marriages by requiring states to recognize legal marriages regardless of “sex, race, ethnicity or national origin.”

The bill came in response to the U.S. Supreme Court’s decision in June to overturn Roe v. Wade, but it included an opinion by Justice Clarence Thomas that suggested same-sex marriage or interracial marriage by overturning two related previous Supreme Court decisions.
