Kayle Fleischauer Retrial – Prosecution Opening Statement

44-year-old Kayle Fleischauer has been granted a retrial after being convicted in June 2019 of 2nd-degree reckless homicide in the killing of his 19-year-old son. He was granted the new trial before his sentencing date. He was originally charged with 1st-degree intentional homicide, but in June a jury returned a guilty verdict to the lesser charge of 2nd-degree reckless homicide.

What is the Defense: Fleischauer testified that he loved his son and would never shoot him. The defense claims the teen accidentally shot himself at his father’s New Richmond home. Gunshot residue was not found on the defendant’s hands but was found on the son’s. Prosecutors said the teen had injuries to his neck, arm, and ear inflicted by his father. The defense contends the two were just wrestling.
